Aldermen say city can revoke business licenses in certain instances

At Monday night's meeting of the Dexter Board of Aldermen, a new ordinance passed that will allow the city to revoke a business license under certain circumstances.

According to Ordinance 4510 as passed, a business license issued under the provisions of Chapter 605 of the City Code may be revoked or suspended by the Board of Aldermen for any of the following causes:

* Any fraud, misrepresentation, or false statement contained in the applications for the license.

* Any violation of the terms or provisions of this chapter.

* Conduct of the business licensed under the provisions of this chapter in such manner as to constitute a breach of the peace, or a detriment to the public health, safety or welfare.

* Failure to obtain a Missouri retail sales license, if such is required.

* Any violation of state or federal law (except traffic tickets), or of any provision of the City Code applicable to the conduct of business.

In the event that a business violates one of these provisions, there is a procedure for the revocation if it is deemed necessary.

First, a notice will be given listing the specific reasons at least ten days prior to the hearing. During the hearing, the Board of Aldermen will determine whether to revoke or suspend the license. Any move will require a majority vote of the Board.

The ordinance also states that the license fee will not be refunded.

Any licensee who continues to conduct business after revocation or during a suspension, will be punished by a fine of $500 or less or a term in the city jail of up to 90 days or by both. It goes on to state that each day's violation will constitute a separate offense.

Following the adjournment of the the Dexter Board of Aldermen, the swearing-in ceremony for the new Board and Mayor was held.

Taking the oath of office were:

* Joe Weber-Mayor for a term of two years

* Ray Pixley-New Ward 3 Alderman for a term of two years

* Tim Aslin-Ward 2 Alderman for a term of two years

* Jerry Corder-Ward 1 Alderman for a term of two years

* Crystal Allstun-City Collector for a term of four years

The Board once again elected Alderman Tim Aslin as President of the Board of Alderman and Crystal Bishop as City Clerk.
