Murder trial set for Welty

Sunday, July 13, 2008

A St. Louis County judge set a trial date Friday for the case against 14-year-old Owen Welty.

Judge John Ross blocked out the entire week of Nov. 10 for the trial that will be taking place in a St. Louis courtroom.

Welty is charged with the Nov. 14, 2006 murder of 64-year-old Don McCollough at his farm east of Bloomfield.

Certified to stand trial as an adult in December 2006, he was incarcerated at the Stoddard County Jail for more than seven months. Upon a motion for change of venue in the summer of 2007, he was transferred to the Cape Girardeau County Jail.

A hearing in late May resulted in his case being moved to St. Louis County.

Throughout the proceedings, Welty has been through several attorneys and is now being defended by N. Scott Rosenblum of St. Louis.

He is facing charges of the Class A felony of First-Degree Murder and the unclassified felony of Armed Criminal Action.

Because of his age, Welty is not eligible for the death penalty. A June 2006 ruling by the U.S. Supreme Court determined that sentencing a juvenile offender to death was unconstitutional even if the defendant is declared an adult.

He faces a maximum penalty of life in prison if convicted.

Welty will be one of the youngest people ever tried as an adult in a Missouri murder case.

Staley....I can't stand by and let those who are wrong go through life on this blog thinking they are right. It is my civic duty as leader of a Nation of Dead Rockers to find errors and correct them.

I like the donating organs thing.....good for all of us to check that on our license and then if we kill someone and get the death penalty, we should do what you said I think.

-- Posted by shannonhoon on Sat, Jul 19, 2008, at 11:30 PM

Lethal injection with his organs to be donated. At least he'd then be giving back.

hoon and dbd - lower the hate and congratulate...dhs73 means no harm. Just b/c he's wrong doesn't give you the right to be rude.

you're about to lose my write-in vote...

Fry the kid. Who cares? The less murderers the better. Plus, killing him is way cheaper than life in prison.

#6. I am smarter than you because I live in a big city and I give blood.

-- Posted by shannonhoon on Wed, Jul 16, 2008, at 11:57 AM

Thanks for the bird dbd but seriously, I'm not good with pets. I'm glad you love your town. I have some great memories of growing up there. You are missing the point. So just to be clear:

#1. "hole" was your word, not mine.

#2. Guess what? Folks here in the big city perform random acts of kindness just like folks there.

#3. I wasn't talking about "all" people from SEMO

#4. Wanting a fair trial based on facts & evidence doesn't mean I don't expect accountability and punishment if the child is found guilty.

#5. If you haven't taken the time to visit one of those blood drives please think about doing so. It only takes a few minutes and can make a big impact in saving lives and it sounds like the hospital needs your help.

Bag....get an hour or two more sleep during the week.

Dolphin....stop being defensive and feel the love from Darrell, I bet he is a looker.

Music City...not worth typing about. Just a poop stirrer like the rest of us, just not very good at it.

Welty....punk murderer hoping for an OJ

Welty family....feel sorry for them having to go through this and don't feel sorry for them knowing how their boy was raised.

Cliff...get a haircut

Bon...drink an Ale for me, ANY.

Corn on the front porch? Are you kidding me?

-- Posted by shannonhoon on Wed, Jul 16, 2008, at 7:43 AM

Here are some insomnia tunes for the dead rockers:

like a lemon to a lime a lime to a lemon, I sip da def ale with all the fly women... waking up but I get to sleep cause I'll be rockin this party 8 days a week - NO sleep till Brooklyn

Everybody sing it with me...UP all night, sleep all day.

-- Posted by dimebag darrell on Wed, Jul 16, 2008, at 3:44 AM

That figures... Cliff probably doesn't appreciate the song like he should! CAWWWWWW!!

You're off the hoook dolphin.

-- Posted by dimebag darrell on Wed, Jul 16, 2008, at 1:04 AM

I didn't start the 18 and Life song...Cliff did...I was just trying to sort out some long-questioned lyrics.

-- Posted by mrsdolphin on Wed, Jul 16, 2008, at 12:47 AM

A couple of thoughts from dbd:

1. I love you dolphin (I use the term love loosely here) but don't waste 18 and a Life on this kid... I can't take it too good of a tune wasted on too big of a piece.

2. A big flying bird to you 73. Thanks for the keeping up with our pints of blood you super sleuth but when was the last time you had someone bring you supper when you were sick, give your kids their hand-me down clothes, have a neighbor drop fresh corn off on your porch? Those are things that happen in this hole you speak of. I am so proud to live here, that I am actually sitting at my computer flipping you off. Don't assume that all people from Southeast Missouri lack intelligence just because we don't support a kid who destroyed a family because he felt like it.

3. Did I mention the bird for 73?

-- Posted by dimebag darrell on Wed, Jul 16, 2008, at 12:07 AM

Thank you layne. Now, as far as I'm concerned, I agree with hoon, yet again. I've said it on a forum about this kid, and other people, before. It's understandable to have the urge to protect your family, especially your children...but if they did it, they did it. Why in the world would you want to make yourself look like a fool trying to defend someone who could kill a human being???

-- Posted by mrsdolphin on Tue, Jul 15, 2008, at 10:30 PM

What are trying to do here nashville73, get into a wetting contest or just bash your former town? None the less, I bet you lose.

-- Posted by BonScott on Tue, Jul 15, 2008, at 10:03 PM

Please...I'm trying to channel Janis Joplin.

Ebonics??? That's so 20th century. How do you bootheelians (or boothooligans) know about Ebonics?

So enough of this madness. Lets talk about how the local hospital had 4 blood drives in 2007 and only managed to collect a total 67 units of blood for the entire year. Whats up with that???

-- Posted by dhs73 to music city on Tue, Jul 15, 2008, at 9:30 PM

Oh, I am over my RIF now that I made the poster. Let me answer your question. If my kid killed a man, I would let the system play out and expect him to receive a punishment. If this still doesn't answer the question....If you mean would I continue to defend him and try to get him off and try to work an OJ...Nope. I would attend the trial and shave my head and carve a nazi sign in my forehead.

I still say, the killer is stalking pastures all over Stoddard Co. running free. The kid is innocent.

-- Posted by shannonhoon on Tue, Jul 15, 2008, at 9:04 PM

nashville73, was that Ebonics you just typed?

-- Posted by BonScott on Tue, Jul 15, 2008, at 8:04 PM

Excuse me but I believe you could quite possibly be the new poster child for RIF. I asked if you would do everything legally possible to ensure your child received a FAIR TRIAL if this were your child in this situation. hkt on fnx wrkt fr me

-- Posted by dhs73 to music city on Tue, Jul 15, 2008, at 6:58 PM

READ....your question WAS answered. Change your name to Janis Joplin if you want, still won't help the fact you apparently can't read. Go to a pasture and sing hippy songs.....won't help your reading ability. IF THAT WERE MY KID....and he shot and killed a man, I would expect there to be a penalty. IF my kid were doing drugs in Bloomfield and were caught....I know there would be a price to pay.

-- Posted by shannonhoon on Tue, Jul 15, 2008, at 5:21 PM

I suggest Janis Joplin, and rock on. But try to stay away from the drugs. They will get you in Bloomfield.

-- Posted by BonScott on Tue, Jul 15, 2008, at 3:49 PM

I guess Ricky's sad story says it all. (Except you didn't quite answer my question.) Now I've got to decide whether to head back to the campfire, pick up my acoustic guitar, flowers, and "Up With People" songbook and travel on to more reasonable pastures or just change my name to Janis Joplin and rock on.

-- Posted by dhs73 to music city on Tue, Jul 15, 2008, at 1:59 PM

Nashville 73. I will answer yours. If Welty was my kid and he shot someone and they died, I would expect him to pay, just like Ricky did in he song. He paid a price for firing that six gun to the wind. So, to answer your question, if Ricky or Welty were my kid, I would expect them too to have consequences for fighting like a switchblade.

-- Posted by shannonhoon on Tue, Jul 15, 2008, at 10:46 AM

I'll answer your question anyway even though you haven't yet answered mine.

If Don McCollough were my husband or father I can't even begin to imagine the heartache and devastion I would feel both for the loss of my loved one as well as the senseless way his life was taken. I'm certain I would be enraged and convinced Owen Welty was guilty of the crime and I imagine I would want all the pain and loss I was feeling to be inflicted upon him and his family. As a victim of this crime I would think my feelings and emotions would be justified.

But the fact is I'm not a victim of this and neither are any of you. What do you accomplish by posting these cruel comments?

-- Posted by dhs73 to music city on Tue, Jul 15, 2008, at 9:51 AM

You answer my question and I'll answer yours.

-- Posted by dhs73 to music city on Tue, Jul 15, 2008, at 6:17 AM

"Accidents will happen" they all heard Welty say.

He fired his six-shot to the wind and that child blew a childaway...

mdolphin - 18 and life you know

-- Posted by layne staley on Tue, Jul 15, 2008, at 4:30 AM

Quick question, Cliff. Is the next line, 18 and life you know? Or 18 and life to go? I LOVE that song...but that's one of those confused lines that so many songs have.

-- Posted by mrsdolphin on Tue, Jul 15, 2008, at 1:10 AM

Welty was a young boy, He had a heart of stone. Lived 9 to 5 and worked his fingers to the bone. Just barely got out of school, came from the edge of town. Fought like switchblade so no one could take him down. He had no money, oooh no good at home. He walked the streets a soldier and he fought the world alone. And now it's 18 and life you got it.

-- Posted by Cliff Burton on Mon, Jul 14, 2008, at 11:37 PM

hey, you had time to think it out, yeah

hey, your weak will won't help her heal her heart, no

hey, i'll bet it really eats you up...

-- Posted by layne staley on Mon, Jul 14, 2008, at 10:27 PM

Jenny I got your number

I need to make you mine

Jenny I don't change that number

867-5309

Its ALL coincidence.

-- Posted by shannonhoon on Mon, Jul 14, 2008, at 4:02 PM

What's with all the dead rockstar names?

-- Posted by jeni70 on Mon, Jul 14, 2008, at 3:22 PM

I would have disciplined the heck out of him growing up and not made a knee jerk reaction to defend him each time he screwed up or acted up.

Just curious, what would you feel or think if Don McCollough was your husband or father and all the evidence in the world pointed to a punk killing him after being warned to stop shooting animals on the same property?

-- Posted by shannonhoon on Mon, Jul 14, 2008, at 2:09 PM

Just curious...what if this were your kid? Would you do everything within the law to ensure your kid got a fair trial or would you just accept that the local courts know best?

-- Posted by dhs73 to music city on Mon, Jul 14, 2008, at 12:36 PM

Don McCollough was an unbelievably great guy. When I was a kid - he was our sunday school superintendent and there was nobody better... His wife and daughter are precious people too. Anyone who would hurt someone in this way, regardless of circumstance deserves ALL that prison has to offer. If his parents hadn't defended him and gotten him out of trouble his whole life Welty may not have felt like he could get away with murder. This is truly one of the saddest cases I have seen, mainly because a family full of truly good people will have to suffer because of one kid's selfishness. AND just to add to the family's suffering, the Welty's are going to drag every part of this out as long as they can. Unbelievable. The Weltys themselves should probably sleep better if he is locked up.

-- Posted by dimebag darrell on Mon, Jul 14, 2008, at 1:32 AM

Now you are talkin'. Any thoughts on parents who defend their kids endlessly, helping them crumble before their eyes and screw up royally due to always be outed?

-- Posted by shannonhoon on Sun, Jul 13, 2008, at 9:13 PM

I say we sit him down beside a camp fire, get out the acoustic guitar, put flowers behind our ears and sing songs. Talk with him a little bit and let him know that everybody makes mistakes, it's going to be ok. And then have a big group hug. That's should do it. Rehabilitation of the 21st century.

-- Posted by BonScott on Sun, Jul 13, 2008, at 12:25 PM

Layne: He didn't do it....the killer is still running loose in pastures all over Bloomfield.

-- Posted by shannonhoon on Sun, Jul 13, 2008, at 11:45 AM

Maybe we ought to try and understand what Welty was feeling when he made this mistake. Let's start by opening up his brain...
